www.hotel-bb.com (the “Website”) is operated by Move On B&B Hotels SAS with a share capital of euros 10.000, registered with the Brest (France) trade and companies registry under number 831 737 168, and whose registered office is located at 271 rue du Général Paulet 29200 Brest (France) (“Move On B&B Hotels” or “we” or “us”).

These Terms of Use (“Terms of Use”) define the legal framework governing access to and use of the Website. Access to and use of the Website are subject to your acceptance of these Terms of Use. We may modify these Terms of Use from time to time in the future. We will inform you of any modification by the way of specific warnings on the Website.

By accessing or using, the Website, you agree to be bound by these Terms of Use as well their amendments in force at the time of your access to the Website. If you do not agree to these Terms of Use, please do not access nor use the Website.

1. The Website

The Website allows you, through an internet single point of entry, to.book your room in any of the B&B Hotels and to provide reviews, feedbacks and comments in relation to your stay in the B&B Hotels.

All offers, booking terms and contracts in relation to any given B&B Hotel, are offered to you and to be entered into with the B&B Hotels affiliate operating said B&B hotel (“B&B Hotels Affiliates”) and under the relevant B&B Hotels’ General Terms of Sale. B&B Hotels Affiliates are listed in the relevant General Terms of Sale.

In the event of contradiction or ambiguity between the terms of these Terms of Use and of the relevant General Terms of Sale with regards to their purpose, the terms of the General Terms of Sale shall prevail.

2. Registration

To access and use the Website or certain services, you may be required to sign up to the Website and/or to the services concerned. As the case may be, please follow the instructions on screen. By using the Website, you represent that:

  • You have the capacity to be bound by these Terms of Use; and
  • You are over the age of 18 years old, or over the age of majority in the country where you reside or are a citizen. Passwords may be communicated to you to complete your account creation or access to some of the Website services. You shall keep your password confidential and any access to the Website through such password will be considered as initiated by you.

3. Rights granted to you

Move On B&B Hotels grants you a personal, non-exclusive, non-transferable and free of charge license to access and use the Website and its content in accordance with these Terms of Use and for your personal and non-commercial use.

You are not authorized to (i) reproduce, display, extract, adapt and/or translate the Website and/or its content or any portion thereof, except as otherwise agreed under these Terms of Use; (ii) to make available to any third party, either directly or indirectly, the Website and/or its content or any portion thereof (iii) to extract or re-use the content of the Website and/or its content or any portion thereof, in whole or part, under whatever format or media ; (iv) circumvent any measures protecting or restricting access to the Website and/or its content or any portion thereof.

Any use of the Website and/or its content or any portion thereof, outside the aforesaid agreed scope, including inter alia for any commercial use, shall be subject to Move On B&B Hotels’ prior and written consent. You may not use the Website and/or its content or any portion thereof in a manner that is illegal, fraudulent, improper or inappropriate. 4. Rights granted by you

By uploading and posting content on the Website, you grant Move On B&B Hotels and the B&B Hotels Affiliates a non-exclusive, irrevocable, transferable and royalty-free right to reproduce, represent, adapt and translate your content including, without limitation: (i) to copy your content, by all means known or unknown such as, but not limited to, paper, electronic, digital including online; (ii) to display or publish your content on the Website as well as any other media known or unknown such as, but not limited to, paper, electronic, digital including online and by any means of broadcasting; (iii) to adapt your content including without limitation, the right to modify, correct, integrate your content, in whole or part, in other works and/or create any derivative work; and (iv) to translate your content in any language or format. Such rights are granted on a worldwide basis, for the maximum duration of protection of intellectual property rights under the applying laws and for any destination including without limitation for information, communication, marketing and advertising purposes.

You agree that you will not upload or post content that is subject to third party intellectual property rights, trade secret or otherwise subject to any third party proprietary rights, unless you are the owner of such rights or have permission from their rightful owner or that is unlawful under applying laws and regulations, including without limitation any content which would (i) be defamatory or libelous, (ii) defend or include crimes against humanity, (iii) incite hatred based on ethnic, sex, sexual identity or handicap or child pornography, (iv) provoke or promote terrorism, (v) incite any type of violence, including violence against women.

More generally, and taking into account the purpose of the Website, you agree to always adopt an ethical behaviour with regards to the content you upload or post on the Website.

5. Proprietary rights

All rights, title and interest in and to the Website, its content, features, graphic chart, database, data and more generally any information contained therein including but not limited to all trademarks, copyright, logos, trade names, drawings, pictures, designs, are the sole and absolute property of Move On B&B Hotels and/or its licensors.

6. User Generated Content

The Website contains content generated by users, including you (“UGC”). Such UGC may be composed of without limitation, reviews, feedback, comments and any other information in relation to such content. We are not responsible for the opinions expressed under such UGC. Opinions and other statements expressed by users are of their own only. UGC is the sole responsibility of the corresponding user. Its accuracy, completeness and reliability are not approved nor endorsed by Move On B&B Hotels nor B&B Hotels Affiliates. You are solely responsible for your content and may be held liable in all respect for your content.

7. Liability

Move On B&B Hotels makes all reasonable efforts to make the Website accessible at all time, but it cannot warrant that it will be continuously available or without defect. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, access to the Website (or any part thereof) with or without notice. You agree that Move On B&B Hotels shall not be liable to you for any such modification, suspension or discontinuance. Except otherwise expressly agreed under the relevant General Terms of Sale, the Website and its content are made accessible on an “as is” and “as available” basis. Move On B&B Hotels makes no warranty nor representation that the Website and its content will be default and error free nor that they will be accurate, up to date or reliable. Move On B&B Hotels reserves the right to correct any errors or omissions and make any amendment on the Webiste. Although Move On B&B Hotels takes reasonable steps to prevent the introduction of viruses or other equivalent, Move On B&B Hotels does not warrant that the Website or content that may be downloaded from the Website does not contain such destructive features. Move On B&B Hotels is not liable for any damages or harm attributable to such features. Move On B&B Hotels is further not liable in respect of any UGC. Move On B&B Hotels will however make all reasonable efforts to promptly takedown any UGC which would be in violation of these Terms of Use, as soon as it is made aware of it, including by the way of a report notice by any user of the Website to be addressed to  +33(0)1 41 48 80 00. You will be responsible for any loss Move On B&B Hotels and/or any B&B Hotels’ Affiliate suffers as a result of your violation of these Terms of Use. You agree to indemnify and hold harmless Move On B&B Hotels and/or B&B Hotels’ Affiliates from and against all losses, expenses, damages and costs resulting from any violation by you of these Terms of Use or of the applying laws.

Move On B&B Hotels does not moderate UGC. However, Move On B&B Hotels reserves the right to review accounts activities and if any illegal, fraudulent, improper, inappropriate or automated use of the Website and/or its content or any portion thereof, by you is found or in the event you violate these Terms of Use or engage in any activity that is harmful to us or our users, we reserve the right to suspend or terminate your access to the Website and/or delete your account without prior notice, without prejudice to any of our other rights.

10. Severability, non-waiver.

The provisions of these Terms of Use are severable and if any of the provisions hereof are held to be invalid, illegal, or unenforceable, in whole or in part, they shall be severed and deleted to the extent required and the remaining provisions shall remain enforceable. Failure by you or Move On B&B Hotels to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.

11. Governing Law

These Terms of Use are governed by French laws. Except otherwise provided under relevant imperative legal provisions which may be applicable to you, any dispute regarding the validity, enforcement and performance of these Terms of Use shall be subject to the exclusive jurisdiction of the courts of Paris (France), reserving however the right to petition before any other competent court.
