General Terms and Conditions - B&B HOTELS Club Loyalty Program in Spain

In Spain, these General Terms and Conditions only apply to Members already active, and to those renewing an ongoing subscription. This B&B HOTELS Club Loyalty Program is not available to new Members.

 

1. Identity of the customers and the service provider
 

1.1 The purpose of these general conditions (hereinafter the "General Conditions") is to regulate the rights and obligations of the members of the B&B HOTELS Club loyalty program (hereinafter collectively referred to as the "Members" and individually each of them as the "Member"), as well as the companies involved belonging to the B&B HOTELS group described below. The B&B HOTELS Club loyalty program service is managed and provided by:

- WE I ALICANTE, SOCIEDAD LIMITADA, a Spanish limited company with registered office at Calle Luis Pasteur S/N, San Sebastián de los Reyes (28703), Madrid (B&B Hotel Madrid Aeropuerto T4) (Spain), registered in the commercial register of Madrid under number B84679935 (Sheet M-404571, Volume 36216, Folio 209).
- WE I VALENCIA SAN LUIS HOTEL, SOCIEDAD LIMITADA, a Spanish limited company with registered office at Calle Luis Pasteur S/N, San Sebastián de los Reyes (28703), Madrid (B&B HOTEL Madrid Aeropuerto T4) (Spain), registered in the commercial register of Madrid under number B84680024 (Sheet M-404570, Volume 37280, Folio 209).
- B&B HOSPITALITY ESPAÑA, SL, a Spanish limited company with registered office at Calle Luis Pasteur S/N, San Sebastián de los Reyes (28703), Madrid (B&B HOTEL Madrid Aeropuerto T4) (Spain), registered in the commercial register of Madrid under number B66209693 (Page M-684467, Volume 38485, Folio 105).

Hereinafter each and every one of them referred to as “B&B HOTELS”. 

Hereinafter, both B&B HOTELS and the Members shall be referred to collectively as the "Parts" and individually each of them as the "Part".

 

1.2. B&B HOTELS offers its members a customer service, accessible by telephone and / or email by sending a request for attention through the following contact form (hereinafter the "Contact Form"). 

 

 

2. Purpose and scope
 

2.1. The B&B HOTELS Club is available at all B&B HOTELS hotels.

2.2. These General Terms and Conditions shall apply as a contract for the provision of services in the context of membership in the B&B HOTELS Club loyalty program (hereinafter referred to as "membership").

2.3. B&B HOTELS allows its affiliated Members to access the digital portal and interface where they can interact and be informed of the Benefits of their membership both through www.hotel-bb.com (hereinafter the "website") and its mobile application (hereinafter the "app"), dedicated to the reservation of hotel services.

2.4 By remaining a registered member of the B&B HOTELS Club, Members accept without reservation the present General Terms and Conditions. The Company may make changes to the General Terms and Conditions at any time. The Customer will be informed of such modifications (e.g. changes to the Benefits, etc.) by e-mail no later than thirty (30) days prior to the entry into force of such modifications. Each new version of the General Terms and Conditions shall be applicable as of the time it is placed online on the Website.

 

3. General conditions of membership in the B&B HOTELS Club Program
 

3.1. To remain a member, the customer must:

  • Be at least eighteen (18) years of age and/or have legal capacity;;
  • Be a resident of Spain;
  • Have a valid personal email address (sharing an email address between two members is not authorized);
  • Have created and maintained an account on the Website under the conditions set forth in clause 4.1 of these General Terms and Conditions.

3.2. Both consumers and professional clients in accordance with consumer legislation may remain members:

  • A consumer Member is understood to be any natural person acting for purposes which do not fall within the scope of his commercial, industrial, craft, independent professional or agricultural activity; 
  • A Professional Member means any natural or legal person, under public or private law, acting for purposes falling within the scope of his commercial, industrial, craft, independent professional or agricultural activity, even when acting in the name and on behalf of another professional. 
     

4.1 Preliminary Step: Accessing an Account
 

4.1.1. Members must maintain an account in their personal space. This will allow you to access the program (hereinafter, the "account") by providing the information required for the program. This information must be complete, accurate, not misleading and updated by sending a request through the Contact Form. B&B HOTELS reserves the right to request Members to confirm, by any appropriate means, their identity, eligibility and the information communicated..

4.1.2. Members shall use their account access credentials in a personal and confidential manner and keep them secret. Members undertake to protect their access credentials, including their password, to prevent any misuse by third parties. 

4.1.3. Each Member is solely responsible for any action taken on his or her account. 

4.1.4. B&B HOTELS is not responsible in any case for the misappropriation of the identity of Members. Any access and action taken from the account of any Member shall be presumed to be made by that Member, to the extent that B&B HOTELS has no obligation or technical means to verify the identity of persons accessing the account.

4.1.5. Any unauthorized connection to the account of any Member and its consequences shall be the sole responsibility of each Member, who must notify B&B HOTELS without delay through the Contact Form. 

 

4.2 Acceptance of the general terms and conditions 
 

4.2.1. B&B HOTELS customers must read these General Terms and Conditions in full and accept them by clicking on "I have read and accept the General Terms and Conditions - continue and pay".  

 

4.3 Confirmation of the order and payment of the price
 

4.3.1. The B&B HOTELS customer has the possibility to verify the details of his membership order, its total price and to correct any errors before confirming the renewal of his account. It is therefore up to the B&B HOTELS customer to verify the accuracy of the membership order before finalizing the cancellation and paying the fee. 

4.3.2. B&B HOTELS will confirm the renewal of the subscription by the customer via email. 

4.3.3. This e-mail confirmation of receipt will always include the Member's identification number. This number is strictly personal and is associated with the Member's name. Membership may not be sold or loaned. It is expressly provided that only one membership per person will be taken into account. Only the Member with a valid subscription may receive the benefits of the program, without the Member being able to assign or transfer its benefits to any third party, unless expressly authorized by B&B HOTELS.

 

5. Description of services covered by membership
 

19. Membership allows a Member to have access, through its account, to the B&B HOTELS Club loyalty program, enjoying the Benefits described below (hereinafter, the "program"). 
 

5.1 Conditions of access to the Advantages
 

5.1.1. The Benefits are valid in B&B HOTELS hotels in the participating countries: France, Spain, Italy, Germany, Belgium, Switzerland, Hungary, Portugal, Austria and Slovenia. To enjoy the Advantages, the Member must log in to his/her digital account via the website or app or provide at the hotel reception his/her name and email address or ID number. 

5.1.2. The Benefits are valid only for stays booked at B&B HOTELS hotels in a participating country through the website, through the app, by telephone or at the hotel reception (hereinafter the "direct channel"). 

5.1.3. All stays booked through an external reseller, tour operator or travel agent (such as Expedia.com, booking.com, etc.) will not qualify for Program Benefits.

5.1.4. Any room paid for directly at a hotel's reservation terminal, without prior reservation, using the member's identification number, will not qualify for program benefits.

 

5.2 Benefits
 

5.2.1 Reductions 
 

5.2.1.1. Any membership subscription shall entitle to: 

 

  • A ten percent (10%) reduction on room rates (except promotional rates) and breakfast, in effect at the time of booking, throughout the year, seven (7) days a week. This reduction is applicable to a room upon arrival at the hotel booked and is not cumulative to special rates, special offers and/or promotions or seasonal reductions. 
  • A five percent (5%) reduction on the reduced room rate and a ten percent (10%) reduction on breakfast, effective at the time of booking, throughout the year, seven (7) days a week. This reduction is applicable to a room upon arrival at the hotel booked and is not cumulative to special rates, special offers and/or promotions or seasonal reductions.

5.2.1.2. It is specified that the Benefits of the B&B HOTELS Club program are not cumulative or compensable with the Benefits of the B&me loyalty program

 

5.2.2 Redemption of accumulated points
 

5.2.2.1 Accumulated points 
 

A stay in a B&B HOTEL contributes to the accumulation of B&B HOTELS Club points, which allow the Member to benefit from one or more bonuses (hereinafter "bonuses"). Only overnight stays made by a Member who has booked through the direct channel are considered valid (hereinafter "valid overnight stays").

The Member will earn one hundred (100) points for each valid overnight stay, for a room, with the exception of rooms paid by voucher. The one hundred (100) points will be added to the Member's account within seventy-two (72) hours after the end of the stay. If the Member books two or more rooms for the same night, the points will be accumulated only for the room he/she occupies.

The total points may be consulted by the Member through his/her account. The Member shall also have access, through his/her account, to a summary list of accumulated overnight stays at a B&B HOTEL. This summary list shall be deemed accurate and complete, unless the Member objects in writing within four (4) weeks of the date of his/her last stay. The summary list will be updated within five (5) business days following the Member's last day of stay at a B&B Club HOTEL. 

The contact details for account access, as well as the accumulated points, cannot in any case be transferred, sold, compensated or combined with the accounts of other Members.

Accumulated points cannot in any case be converted into cash value and do not grant any right to reimbursement.

 

5.2.2.2 Period of Validity of Points 
 

The points added to the Member's account shall be valid until thirty (30) days after the expiration date of the membership. If the Member does not renew his/her membership within such period, the unconverted points will be definitively lost. 

However, Members are entitled to renew their membership up to thirty (30) days after the membership expiration date. In this case, the points will not be lost and will be accumulated with future points until the next membership expiration date. Membership renewal shall in any case be made by the Member with its express consent and shall in no case be made automatically.

5.2.2.3 Conversion of Points 
 

Once the Member has accumulated the required minimum number of points, he/she can convert them into a voucher through his/her account. His voucher will then be available in his account. 

  • Once the Member has accumulated three hundred (300) points, he/she can benefit from a voucher for one free breakfast at any B&B HOTELS hotel in a participating country.
  • Once the Member has accumulated five hundred (500) points, he/she can benefit from a voucher for two free breakfasts at any B&B HOTELS hotel in a participating country.
  • Once the Member has accumulated one thousand (1000) points, he/she can benefit from a voucher for a maximum value of 60 € to be used in any B&B HOTELS hotel in a participating country

Validation of vouchers is subject to availability of rooms and breakfast services at the hotel. Stays paid by voucher will not allow the accumulation of points.

Bonds are valid for twelve (12) months from the date of issue. The Member may use its bond in two ways: 

 

  • Through the website or app, by entering the voucher number when confirming your purchase, or by presenting it at the hotel counter.

The voucher is considered used once the reservation made with the voucher has been confirmed (online or once it has been entered into the electronic reservation system by the hotel's reception staff). 

The voucher may be canceled and refunded only if permitted by the cancellation conditions of the reservation in question.
 

5.2.3. Non-transferable Benefits
 

With the exception of bonuses, program benefits are personal and non-transferable. 

Reductions may only be applied to reservations made by the Member for his/her own stay. 

 

6. Effective date of membership
 

Membership is deemed renewed on the date of acceptance of these General Terms and Conditions (hereinafter the "Effective Date") and payment of the renewal fee. From that date, the Member shall continue to benefit from the Membership Advantages.

 

7. Duration of Membership
 

The membership is concluded for a period of one (1) year, renewable, as of the effective date of the membership, except in case of termination by one of the Parties under the terms and conditions of clause 10. 

  1. The Member may renew the membership within thirty (30) days following the date of its expiration..
     
  2. In the event of membership renewal, the points accumulated in the program shall be retained. However, if the Member does not renew the membership within the stipulated term, the membership will not be automatically renewed and the remaining points will be definitively forfeited. 

     

8. Fees and terms of payment 
 

The membership fee is thirty-nine (39) euros inclusive of taxes at the rate in effect on the date of renewal (hereinafter referred to as the "membership fee"). 

Any change in the applicable fee may have an impact on the amount of the membership fee. 

The renewal of the membership will generate a new obligation for the Member to pay the fee to continue benefiting from the services of the program. 

When renewing the subscription as a Member, payment will be made online by credit/debit card (visa, mastercard, american express). 

 

9. Obligations of the Members
 

Each Member undertakes not to cause any disturbance to public order, to comply with the laws and regulations in force, to respect the rights of third parties and to comply with the provisions of these General Terms and Conditions.

In particular, each member shall be obliged to:

  • Behave fairly and loyally with respect to B&B HOTELS;
  • be honest and truthful in the information provided to B&B HOTELS. 
  • To use the functionalities of the membership in accordance with its purpose described in these General Terms and Conditions.
  • Not to misuse the program to commit crimes or offenses punishable by criminal law or any other law;
  • Respect the privacy of third parties and the confidentiality of correspondence
  • Respect the intellectual property rights of B&B HOTELS covering elements of the program
  • Not to modify the information put online by B&B HOTELS 
  • Not to disseminate data that would have the effect of diminishing, disorganizing, slowing down or interrupting the normal operation of the program or the site. 

The Member agrees not to behave in a manner contrary to accepted standards of morality or public order, nor to commit any act of vandalism, damage or nuisance in the context of the program Benefits obtained under the membership. 

The Member shall use the functionalities of the program accessible on the website and app under its sole and exclusive responsibility. 

 

10. Termination of Membership  
 

10.1 Termination of membership on the Member's initiative 

The Member may terminate its membership before the expiration date of the membership in case of breach by B&B HOTELS of its obligation to provide the services object of the membership, in accordance with the provisions of art.78 of the LGDCU and the current legislation applicable for these purposes in accordance with the fulfillment of contractual obligations, as provided for in 1.124 of the Civil Code. 

The Member may request the termination of the membership by sending the request through the Contact Form whose link is, contact form stating in any case the reason for termination. For these purposes and if applicable, B&B HOTELS will have a period of seven (7) working days to remedy and / or compensate the Member for the alleged breach, in the event that the breach was not remedied and / or compensated within that period, B&B HOTELS will proceed to the termination of membership as indicated below.

Once the case has been analyzed by B&B HOTELS, and if applicable, the latter will immediately proceed to the termination of the program and will send the member a confirmation email.

In these cases, the termination will cause the loss of all unused Benefits related to the program, from the date of receipt of the termination request. 

 

10.2 Termination of membership at the initiative of B&B HOTELS
 

B&B HOTELS may terminate the membership in the event of non-compliance by the Member with its obligations under these General Terms and Conditions, which may be due, inter alia, to non-payment of the fee, fraudulent conduct by the Member or failure to comply with the conditions of membership of the program listed in clause 3 (lack of legal capacity, etc.). B&B HOTELS reserves the right, at any time, to carry out checks on the use of the program and compliance with the rules of these General Terms and Conditions. In case of termination of membership at the initiative of B&B HOTELS in the cases mentioned above, all points accumulated by the Member will be lost and the Member will not be entitled to enjoy the Benefits from the time of such termination.

For commercial reasons, B&B HOTELS reserves the right to unilaterally resolve and terminate Members' membership at any time. This unilateral termination will be communicated to Members via email or any other agreed communication channel through the Website or the App, one (1) month in advance of the intended termination date.

 

11. Responsibility
 

B&B HOTELS will not assume any liability if it proves that the Member has incurred in breach or improper execution of these General Conditions, as well as the breach of the General Conditions by acts of a third party contractor or an event of force majeure, as defined by the applicable Spanish laws and jurisprudence.

 

12. Protection of personal data
 

B&B HOTELS collects and processes the personal data of its members in accordance with the applicable regulations on the protection of personal data and, in particular, EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 and the law on information technology. and civil liberties, as amended.

In accordance with the applicable regulations, the affiliate has the right to access and rectify his/her personal data. He/she may also demand restrictions to the processing of his/her data, if necessary, oppose to its processing/withdraw his/her consent.

These rights may be exercised under the terms and conditions defined in our Privacy Policy. 

 

13. Intellectual Property
 

The present General Conditions do not imply any transfer of any kind of property rights, including intellectual property rights, on the elements belonging to B&B HOTELS in favor of the Member; the Member undertakes in any case not to act in any way that may prejudice or compromise, directly or otherwise, the intellectual property rights of B&B HOTELS.

In this regard, it is specified that the content of the website, the general structure and brands, designs, animated images or not, texts, photographs, logos, graphic charts, software and programs, search engines, databases, sounds, videos, domain names, the design and all other elements that make up the articles and the website, or any other information appearing therein, without limitation, are the exclusive property of B&B HOTELS or are licensed to partners or third parties, and are protected by intellectual property rights that are or will be recognized under the laws in force.

Any reproduction and/or display, in whole or in part, of any of these elements without the express authorization of B&B HOTELS, is prohibited and shall constitute, inter alia and non-exclusively, an infringement covered by the provisions of the Intellectual Property Code.

 

14. General Provisions
 

If any provision of these General Terms and Conditions is held to be unlawful or unenforceable by a court decision, the remaining provisions shall remain in force.

The information provided by the website shall be official and binding between the Parties. Elements such as the date and time of receipt or issuance, as well as the quality of the data received, shall be official and binding on a priority basis as they appear in the information systems of B&B HOTELS, unless Members provide written proof. The scope of proof of the information coming from B&B HOTELS information systems shall be that recognized in the original document written on paper and signed by hand.

 

15. Dispute 
 

15.1 With respect to consumer Members
 

 The General Conditions shall be executed and interpreted in accordance with Spanish law. In case of dispute, the Member should contact as a priority the B&B HOTELS customer service to reach an agreement.

It is reminded that, for any information or complaint, the B&B HOTELS customer service is at the Member's disposal by e-mail, by sending a request through the Contact Form.

In accordance with articles 57 and 58 of the LGDCU, the consumer Member is offered the alternative that for the purposes of these General Conditions, may resort, free of charge, to the consumer arbitration service in order to resolve any disputes that may arise in connection with these General Conditions.

For these purposes, the Parties may invoke their rights in accordance with the LGDCU and Royal Decree 231/2008 of February 15, 2008, which regulates the Consumer Arbitration System, as well as all other applicable laws and supplementary regulations, and in particular, in accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission allows an online dispute resolution procedure through its online dispute resolution platform: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show…

In no case shall this clause mean the loss of the option to effective judicial protection in favor of the consumer Members, except when the applicable legislation so specifically contemplates.

 

15.2 About Professional Members 
 

The Parties shall endeavor to resolve by agreement any dispute arising between them with respect to the interpretation, performance or termination of the General Conditions. 

For the resolution of any dispute relating to the General Conditions, the Parties agree that in any case the applicable law shall be Spanish law and the competent courts to resolve any dispute relating to these General Conditions shall be the courts of the Community of Madrid.
