1. Preamble 

 

1. The purpose of these general terms and conditions (hereinafter the "general terms and conditions") is to govern the rights and obligations of members (hereinafter the "members") of the B&me programme (hereinafter the "programme"), and of the following companies:  

  • B&B HOTELS, a société par actions simplifiée (simplified joint stock company) under French law, with its registered office at 271 rue du Général Paulet, 29200, Brest (France), registered in the Brest Trade and Companies Register under no. 378 047 500.
  • B&B DREAMLAND HOTEL, a société par actions simplifiée (simplified joint stock company) under French law, with its registered office at 271 rue du Général Paulet, 29200, Brest (France), registered in the Brest Trade and Companies Register under no. 808 416 960.
  • TANDEM SAS, a société par actions simplifiée (simplified joint stock company) under French law, with its registered office at 9 boulevard Romain Rolland 75014 Paris (France), registered in the Paris Trade and Companies Register under no. 908 119 746.

hereinafter referred to as "B&B HOTELS" or the "company".

    
2. B&B HOTELS provides its members with a customer service accessible by sending a request via the Contact Form.
 

2. Purpose and scope

 

3. These general terms and conditions apply to UK customers. The programme is directed to UK customers,

4. B&B HOTELS offers a B&me loyalty programme to its business and consumer customers, via the hotel-bb.com website (hereinafter the "site") and its mobile application (hereinafter the "Application"), dedicated to booking hotel services.

5. Members are expressly informed that these general terms and conditions do not govern: 

  • The use of the site, which is governed by the Site's General Terms and Conditions of Use, accessible here;
  • the booking of a hotel room, which is governed by the General Terms and Conditions of Sale available here; and
  • A paid subscription to the B&me CLUB programme, reserved for members who have subscribed to the B&me CLUB programme, which is governed by the B&me CLUB programme General Terms and Conditions accessible here
     

3. Conditions of eligibility for the programme 

 

6. To join the programme, members must:

  • be at least eighteen (18) years old and/or have legal capacity (B&B HOTELS reserves the right to carry out any verification to ensure the member's capacity to participate in the programme).

7. The programme applies to both consumer and business customers:

  • consumer” customer means any natural person who is acting wholly or mainly outside their trade, business, craft or profession;
  • business customer” or “trader” means any natural person, acting for purposes relating to their trade, business, craft or profession.

8. B&B HOTELS reserves the right to carry out any verification to ensure the member's ability to participate in the programme. 
 

4. Joining the programme  

 

4.1 Programme registration 

9. B&B HOTELS customers subscribe to the B&me programme free of charge: 

  • by filling in a dedicated form on the www.hotel-bb.com website to create an account on the B&me customer area or on the B&B HOTELS mobile application, available in French, English, Spanish, Portuguese, German and Italian. 
  • when booking a room on the site; or
  • directly with the hotel.

 

10. All the information the member provides to B&B HOTELS when joining the programme or thereafter must be complete, up to date, and accurate including but not limited to its identity and contact details.

11. B&B HOTELS reserves the right to ask the member to confirm, by any appropriate means, their identity, eligibility and the information provided.

12. The member shall update their information through their B&me account to ensure it is always complete and accurate. When this is not possible the member may submit the updated information via the Contact Form.

13. Membership is personal and only the member who has subscribed to the programme may benefit from it. Use of the programme by anyone other than the member is prohibited.

14. It is expressly stated that the programme is entirely paperless. Therefore, no physical medium (e.g. a loyalty card) will be given or sent to the member when they subscribe to the programme.
 

4.2 Acceptance of terms and conditions 

15. By registering to the programme and creating a B&me account the member confirms their acceptance of these general terms and conditions and agreement to comply with them.  

16. These general terms and conditions are available to the member during the registration process and at the bottom of each page of the site through a link. The member shall read these general terms and conditions carefully before joining the programme and keep a copy.

 

5. The benefits of the programme 

 

17. The programme makes available to members the benefits specified in the site at: https://www.hotel-bb.com/en/loyalty-program-advantages-and-status. The benefits of the B&me programme may vary from one country to another.      Please check the site regularly.

18. The benefits of the B&me Programme: 

  • are not transferable; 
  • are not refundable;
  • cannot be combined with bookings made with a corporate code;
  • cannot be combined with discounts granted as part of the B&me CLUB loyalty programme;
  • can only be used when bookings have been made on the Site and Application. 

 

19. The member acknowledges and agrees that B&B HOTELS may amend or discontinue the programme at any time partly or as a whole.        B&B HOTELS will inform members by email if and when the programme is discontinued.
 

6. Effective date and duration of the programme 

 

20. Upon registration, the benefits the member accrues through the programme are available to the member, for an indefinite period, until the termination of the membership under these general terms and conditions or discontinuance of the programme.
 

7. Members' obligations 

 

21. When joining the programme, each member shall comply with applicable laws, respect the rights of third parties and comply with these general terms and conditions.

22. In addition but without limitation, each member agrees:

  • to only have one membership at any time and be the only one (18 year’s old or older) using the membership. Member must not share the membership with anyone;
  • not to register as a legal entity or on behalf of a legal entity;
  • to use only one email address for their account;
  • to pay for hotel’s charges and other expenses they incur during any stay in a B&B HOTELS’ and
  • not to exert physical, verbal, or written abuse or harassment to B&B HOTELSs staff.

 

23. The Member confirms that :

  • they are a registered guest staying at the hotel in which they use the benefits;
  • they have provided complete and accurate information to B&B HOTELS;
  • the name as shown on the membership matches their legal identification; and
  • are at least 18 years of age.

 

8. Cancellation of the programme 

 

8.1 Membership termination and Deregistration from the programme by the member

 

24. Members may request to terminate their membership to the programme and be removed from the programme at any time directly from their member account or by sending a request via the contact form.

25. B&B HOTELS will terminate the membership, and deregister the member from the programme as soon as possible and will send a confirmation e-mail to the member.

26. Termination of the membership in the programme will result in the termination of the contract between the parties under the general terms and conditions, the deletion of the member's "B&me" digital account and the loss of all unused benefits linked to the programme, from the date of receipt of the request to unsubscribe. 
 

8.2 Termination of the membership by B&B HOTELS 

 

27. B&B HOTELS may suspend or terminate the membership immediately by giving written notice to the member at any time for convenience or in the event of breach by the member of any of its obligations under these general terms and conditions, fraudulent behaviour by the member or failure to comply with the conditions of eligibility for the programme set out in article 3 (lack of legal capacity, etc.).

28. The termination of the membership under the programme, will result in the termination of the contract between the parties under the general terms and conditions, the deletion of the member's "B&me" digital account and the loss of all unused benefits linked to the programme, from the date of termination.
 

9. Liability  

 

29. B&B HOTELS shall not be liable for any breach of these general terms and conditions if this is attributable to actions or omissions of the member, or to the act of a third party to the contract, or to a case of force majeure.

30. If the member is a consumer or a business user

  • B&B HOTELS do not exclude or limit in any way its liability to the member where it would be unlawful to do so. This includes liability for death or personal injury caused by B&B HOTELS’s negligence and for fraud or fraudulent misrepresentation.
  • B&B HOTELS’ total liability to the member under these general terms and conditions is limited to £100.
  • Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to member, which will be set out separately in the relevant terms and conditions.

 

31. If the member is a business user:

  • B&B HOTELS excludes all implied conditions, warranties, representations or other terms that may apply to the programme.
  • B&B HOTELS will not be liable to the member for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: (i) use of, or inability to use, the membership; or (ii) use of or reliance on any content displayed on the site and/or the Application.
  • In particular, B&B HOTELS will not be liable for direct or indirect: (i) loss of profits, sales, business, or revenue; (ii) business interruption; (iii) loss of anticipated savings; (iv) loss of business opportunity, goodwill or reputation; or (v) any indirect or consequential loss or damage.

 

10. Changes to the loyalty programme 

 

32. The present general conditions may be modified and updated by B&B HOTELS at any time, at its sole discretion.

33. The general terms and conditions in force are the latest version available on the site.

34. Members will be informed of any substantial changes by e-mail no later than thirty (30) days before the changes take effect.
 

11. Protection of personal data 

 

35. B&B HOTELS collects and processes the personal data of its members in compliance with applicable data protection laws, including but not limited to Regulation EU 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “GDPR"), the version of the GDPR retained in the UK (the “UK GDPR”).

36. Members have a right of access, modification, rectification, opposition, portability and limitation under the terms and conditions defined in its Privacy Policy. 
 

12. Intellectual property

 

37. These general terms and conditions and the membership to the programme do not transfer any property rights of any kind, in particular intellectual property rights, to the member, who shall not infringe directly or indirectly the intellectual property rights of B&B HOTELS.

38. In this respect, the member acknowledges and agrees that the content and the general structure of the site and the Application, as well as without limitation the brands, drawings, models, images, whether animated or not, texts, photographs, logos, graphic charters, software and programmes, search engines, databases, sounds, videos, domain names, design and all other elements of the site and the Application or any other information appearing on it, are the exclusive property of B&B Hotels or of partners or third parties who have granted it a licence, and are protected by intellectual property rights.

39. The member must not modify the paper or digital copies of any materials, available on the site, the Application or otherwise, and must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

40. The member must not use any part of the content on the site and Application for commercial purposes without obtaining a licence to do so from B&B HOTELS or its licensors.

41. If the member prints off, copy, downloads, shares or reposts any part of the site or Application in breach of these general terms and conditions, the member’s right to use the site or Application will cease immediately and the member must, at B&B HOTELS’s option, return or destroy any copies of the materials they have made.
 

13. General provisions 

 

42. If one of the clauses of these general terms and conditions is considered unlawful or unenforceable by a court decision, the other provisions will remain in force.

43. B&B Hotels may assign or transfer any rights or obligations under these general terms and conditions, to a third party at any time, at B&B HOTELS sole discretion.

44. No failure or delay on the part of B&B HOTELS in exercising any right or remedy hereunder or enforcing these general terms and conditions will operate as a waiver thereof.
 

14. Disputes 

 

45. B&B HOTELS would appreciate a chance to deal with the member’s concerns. To report any issues or complaint, the member may contact the B&B HOTELS customer service via the Contact form.

46. If the member is a consumer, please note that these general terms and conditions, their subject matter and their formation, are governed by English law. The member and B&B HOTELS both agree that the courts of England and Wales will have exclusive jurisdiction except that if they are a resident of Northern Ireland they may also bring proceedings in Northern Ireland, and if they are resident of Scotland, they may also bring proceedings in Scotland.

47. If the member is a business customer, these general terms and conditions, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. B&B HOTELS and the member both agree to the exclusive jurisdiction of the courts of England.
