When you interact or communicate with us, including communication with our customer service representatives or participating in any of our programs (including our loyalty program) or events;
When you purchase or use our products, services, or features;
If you engage with us on social media;

By using our Services, you acknowledge the terms of this Policy. If you do not understand or agree with the terms of this Policy, please do not use our Services. Our Services may include links to websites and/or applications operated and maintained by third parties. Please note that we have no control over the privacy practices of websites or applications that we do not own. We encourage you to review the privacy practices of those third parties.

2. Changes to this Privacy Policy

We may modify this Privacy Policy from time to time, in which case we will update the “Last Revised” date at the top of this Privacy Policy, post the updated version on our Services and take any other steps required by applicable law. If you do not agree to any updates to this Privacy Policy, please do not continue to use or access the Services.

3. How We Collect Your Personal Information

We collect information from or about you in various ways when you visit our hotels or interact with our services. We may also collect information about you from third parties.

Information we collect from you directly. We need to collect Personal Information from you in order to provide you with our Services, as well as to improve your experience. You may provide us with Personal Information in several ways, including, for example when you:
Visit our Site or use our Application
Make a reservation at, visit, or otherwise interact with one of our properties, including use of the WiFi and other services on property
Register for or create an account with us, including signing up for our loyalty program;
Correspond with us in any way, including through questionnaires and surveys;
Provide contact information to receive our newsletter or promotional information;
Interact with customer service, support, or other assistance, including through our social media pages; or
Provide information to use for any other reason, online or offline.
Information we collect automatically. We, and third parties on our behalf, may automatically collect certain information about your interactions with the Services and emails, including through cookies and other tracking technologies (“Tracking Technologies”). We collect
this information to better tailor your experiences with the Services, run analytics, and improve our services.
Information we collect from third-parties. We also may collect Personal Information from other sources, such as our partners or third-party booking services.

4. The Types of Personal Information We Collect

The Personal Information we collect from our hotel customers, prospective customers, and visitors to our Site and Application help us deliver our Services, personalize your stay, and improve your overall experience with us.

Depending on the nature of your interaction with B&B HOTELS, we may collect, store, and use the below categories of information:

Information relating to your identity, including first and last name, address, date of birth, gender, profession and/or company information, nationality, passport or other government-issued identification, and information included on government-issued identification;
Contact information, including address, zip code, telephone number, and email address;
Reservation information, including arrival and departure dates, details of other occupants of the rooms booked such as names and ages, preferences (smoking room, preferred floor, etc.), travel reason;
Payment Information, including credit card or other payment information any spending or transaction history related to our Services, details of any purchase, subscription or service subscribed to, information relating to payment history such as payment terms, discounts granted, receipts, balances, and unpaid invoices.
Images or sound information, including photographs or information collected through closed-circuit television and other security measures at our property that may capture or record guests and visitors in public areas or for the protection of our personnel, guests, and visitors, where permitted by law.
Customer feedback information, including information gathered through post-stay surveys, guest feedback, or reviews posted to our Site or social media accounts.
Information relating to browsing on our Site or Application, including logs and connection data, computer hardware identification data, language preferences, geographical location data, data relating to your use of the Platform and Services, including information communicated to our teams when you make requests (language preference, etc.) information collected via cookies and other tracers.

If you are a job applicant, we may collect your contact information as well as certain information about you, including, race, ethnicity, previous employment and education history, references, information relating to disabilities, physical or mental health information, sexual orientation, veteran status, trade union membership, immigration or naturalization records, information relating to your criminal record and background check, interview notes, and any correspondence between us.

5. How We Use Your Personal Information

We primarily use Personal Information to provide, maintain, and improve our Services, but we may also use Personal Information for the following purposes:

To facilitate your interactions and transactions with us, such as to make reservations at our hotels or fulfill other requests for support or additional Services, in order to fulfil our contract with you;
To respond to your requests, communications, suggestions, comments, inquiries, and requests (including your feedback about our Services), in our legitimate interests to resolve your queries and provide information to you in order to generate and develop our business;
To offer, manage, and administer our loyalty program, in order to fulfil our contract with you;
To improve or develop new products, features, and services, with your consent (if required under applicable law) or for our legitimate interests to run an effective business;
To better understand and address the preferences of our customers, in our legitimate interests to grow our business;
To provide personalized Services, including personalized experiences, content, marketing materials, and ads, with your consent (if required under applicable law);
To analyze product performance, maintenance, and operations, in our legitimate interests to run a successful business;
To provide you with, and improve, relevant marketing offers or information from us or relevant third parties, with your consent (if required under applicable law);
To offer targeted advertising according to your relevant interests, with your consent (if required under applicable law);

Finally, we may deidentify your information such that it cannot reasonably be linked to you and use such deidentified information in accordance with applicable law. To the extent we process any deidentified information, we will maintain and use such information in deidentified form and not attempt to re-identify the information, except as permitted by law.

6. How We Share Your Personal Information

We may share your Personal Information with certain trusted parties in some circumstances, including:

With authorized staff of our subcontractors and service-providers, including hosting and cloud storage providers, payment service providers, suppliers of software for checking identity documents and suppliers of mailing services, IT maintenance service-providers, marketing research service-providers, in order to perform our contract with you and in our legitimate interests to run a successful business;
With B&B HOTELS affiliates, in order to perform our contract with you and in our legitimate interests to run a successful business;
With third parties for advertising and marketing purposes, such as business partners and other websites and platforms that drive traffic to our website, with your consent (if required under applicable law);
With law enforcement agencies, public authorities or other third parties if required to do so by law or if we have good belief that such sharing is reasonably necessary to comply with legal obligations, process, or request (such as a subpoena, court order, or warrant), or to comply with the legal or regulatory requirements from regulators or law enforcement authorities. We may also share your information to enforce our terms and other agreements (including investigation violations of such agreements), to detect or prevent fraud or security violations, and to protect the rights, property, or safety of B&B HOTELS, staff, guests, or other third parties.
With third parties in connection with or anticipation of an asset sale, merger, or other business transaction, including in the context of a bankruptcy, on the basis of our legitimate interests to run a successful business;
With other third parties for whom we have obtained your permission to disclose your Personal Information.

B&B HOTELS maintains technical and organizational measures to protect against unauthorized or unlawful processing of Personal Information and/or against accidental loss, alteration, disclosure or access, or accidental or unlawful destruction of or damage to your Personal Information.

While we do our best to protect your Personal Information, no system or system for the transmission of information via the internet can be guaranteed as completely secure.

We retain your information for as long as is reasonably necessary for the purposes specified in this Policy. When determining the length of time to retain information, we consider various criteria, including whether we need the information to continue to administer your account, provide the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property or products.

Use of Third-Party Services

Certain third-party services, websites, or applications that you use to navigate to and from our Site or to book a reservation with our properties may have separate user terms and privacy policies that are not covered under this Policy. B&B HOTELS is not responsible for the privacy practices of these third-party services or applications.

Children’s Privacy

We do not knowingly collect Personal Information from children or other persons who are under 13 years of age (or otherwise considered a child in a relevant jurisdiction). Individuals who are children or those under the age of 13 should not attempt to provide us with any Personal Information. Appendix A: Additional Provisions for Residents of Certain US States

This section applies if you are a resident of California, Colorado, Virginia or another U.S. state that has passed a privacy law similar to the California Consumer Privacy Act (“CCPA”) and requires specific privacy notice disclosures. For purposes of this section, references to “Personal Information” shall also include “sensitive Personal Information” as those terms are defined under the CCPA.

We do not have actual knowledge that we “sell” or “share” (as those terms are defined under the CCPA and used throughout this section) Personal Information of residents under 16 years of age. However, we do share certain categories of Personal Information and, in the preceding 12 months, we have shared the following categories of Personal Information with third parties for advertising and marketing purposes about residents. For purposes of the CCPA, this may also qualify as a sale or sharing of Personal Information.

We will make reasonable good faith efforts to remove the review from prospective public view or anonymize it so the minor cannot be individually identified. This removal process cannot ensure complete or comprehensive removal. For instance, third parties may have republished the review and archived copies of it may be stored by search engines and others that we do not control.

We will not discriminate against you for exercising any of these rights. Further information may be needed to verify your identity before exercising these rights, such as your email address or government issued ID. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

If we deny your request regarding a privacy right, you have the right to appeal our decision. In order to appeal a declined request, please email us at customerservice-us@hotelbb.com.

Appendix B: Notice of Financial Incentives

Summary of Incentive and Material Terms

B&B HOTELS offers users in the United States the ability to register for a free customer loyalty program. Because our loyalty programs involve the collection of Personal Information, it may be interpreted as a “financial incentive” program or “bona fide loyalty program” under state law. The benefits of becoming a member of our loyalty program includes discounted rates on hotel stays. :

We may use the Personal Information you provide us in accordance with our privacy policy, including to send communications to you, and to market future products, services, or features.

Opt-In

By participating and signing up for one of our loyalty programs, you are affirmatively opting-in to receive the financial incentives described in this notice.

Right to Withdraw

You have the right to withdraw from the loyalty program and financial incentive at any time. You may submit a request to withdraw by contacting us at customerservice-us@hotelbb.com.

How the Incentive is Reasonably Related to the Personal Information Provided

The value of any financial incentive we offer is reasonably related to the value of any Personal Information you provide to us. We estimate the value of your Personal Information by considering, without limitation, the expenses we incur from collecting your Personal Information and/or providing the financial incentive to you, the revenue generated by your use of the financial incentive, and any improvements we can make to our products and services based on aggregating information obtained through the financial incentive program.

Appendix C: Additional Provisions for Individuals using the Services from the European Economic Area (EEA) and United Kingdom (UK)

If you are accessing our Site and making a reservation from outside the United States, the B&B entity in the country in which you are located will act as a joint data controller alongside B&B Hotels in relation to the processing of your Personal Information. Please see here for a list of data controllers for each country and relevant privacy policies for each entity. B&B HOTELS has entered into an agreement with relevant joint controllers which sets out their respective obligations. Where we Store your Personal Information

The Personal Information that we collect from you will be accessed from, transferred to, and stored and used in countries outside the EEA and UK, by us and by our third party service providers or partners. We will take all steps reasonably necessary to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy.

Transfers of Personal Information outside the EEA or the UK will be governed by the European Commission’s standard contractual clauses for the transfer of Personal Information to third countries (specifically, module one (controller to controller transfer) and/ or module two (controller to processor transfer), as relevant) or the UK Information Commissioner’s international data transfer addendum to the EU standard contractual clauses, as relevant, unless the data transfer is to a country that has been determined by the European Commission or the relevant UK authorities, as applicable, to provide an adequate level of protection for individuals’ rights and freedoms for their information.
